In South Carolina all marital litigation having to do with the divorce and separation issues of custody and support, division of marital property and marital debt are handled in Family Court.
Five grounds for divorce are available in South Carolina: adultery, physical cruelty, habitual drunkenness (drugs or alcohol), and desertion. A divorce can also be granted after one year of continuous separation.
After the husband and wife are separated, they can file for a "decree of separate support and maintenance" and ask the Court to decide all the same issues that are decided in a divorce action except for the divorce itself.
If parents cannot agree on who should have custody of their minor children, the Court will decide. There are many factors that the Court will consider in determining custody and what is in the best interest of the child.
